What is the City of Brisbane Act and Regulation?

The City of Brisbane Act 2010 (the Act) and the City of Brisbane Regulation 2012 (the Regulation) create a framework for Council’s daily operations and long-term plans. 

The Act constitutes the unique nature and extent of Council’s powers and responsibilities. It makes Council responsible for the good rule and governance of Brisbane. 

The Act is underpinned by local government principles such as:

  • making decisions in the public interest
  • transparent and effective processes
  • sustainable development and management of assets and services
  • democratic representation, social inclusion and meaningful community engagement
  • good governance of, and by, local government
  • ethical behaviours of councillors, councillor advisors and Council employees.

Together with the Regulation, the Act requires that key Council documents be publicly available. These include documents relating to finance, policies and the Annual Plan and Budget.

Responsibilities

The Act outlines Council’s powers and responsibilities in relation to:

Council committees

The Act appoints an Establishment and Coordination Committee (Civic Cabinet) to coordinate the business of Council.

Local laws

The Act empowers Council to make and enforce local laws that are necessary and convenient for the good rule of Brisbane. 

Councillors and wards

Under the Act, each ward of Brisbane must have a fair proportion of voters and Councillors must act in the best interest of residents.

Roads

Under the Act, Council has control of all roads in Brisbane. It can construct and improve roads and make local laws relating to road use.

Finance and accountability

The Act and the Regulation allows for Council to charge rates and fees on land and for services, facilities and activities provided by or on behalf of Council.
