Privacy statement

Council will take all reasonable and appropriate steps to protect the privacy of individuals as required by the Information Privacy Act 2009 (the Act) and the Information Privacy Principles contained in the Act.

When collecting your personal information, Council will: 

  • respect and protect your personal information 
  • use it only for the purpose for which it was collected 
  • disclose it to external organisations, where there is a legal requirement, or where it is contracted as part of a service on Council’s behalf.

We will:

  • tell you for what purpose we will be collecting the information
  • tell you what information is necessary to access Council's products and services, including payments and transactions
  • tell you when the information needs to be passed on to Council’s contractors and agents who carry out activities on Council’s behalf
  • not ask for or collect any sensitive information about you unless it is necessary to meet legal, public interest or statistical requirements.

When you provide Council with your personal information, Council will:

  • use the information to help you use Council services
  • gather the data for analysis
  • remove personally identifiable characteristics, unless you have given us specific consent to recognise your usage on an individual basis.

Council will not disclose your personal information to any other person or organisation unless one of the following reasons applies:

  • you have given us your consent to do so
  • Council is required by law or authorised to do so under a law
  • there are grounds to believe disclosure will prevent a threat to life or health
  • that person or organisation is providing a service to Council and is required to maintain the same or similar privacy legislation principles
  • Council is of the opinion that it is unable to assist with your request and that another government agency or authority is more capable of assisting, or has the appropriate jurisdiction to assist with your request.

When handling your personal information, Council will:

  • take reasonable steps to ensure that all information we collect, use or disclose is securely stored
  • monitor transmissions sent to or from Council for quality control and systems administration
  • strive to protect your personal information from misuse, loss and unauthorised access.

You can access and update the personal information you have given us.

In accordance with our obligations under the Act, we will take reasonable steps to correct and update your personal information if it is:

  • misleading
  • inaccurate
  • incomplete
  • out of date.

Depending on the information to be amended, you may need to to submit a Privacy Information Amendment application, available on the Queensland Government's Right to Information website.

If you think Council has breached your privacy and confidentiality, you may lodge a complaint by contacting Council. We will take your complaint seriously, investigate thoroughly and provide you with a response.

If you are not satisfied with our response, you may make a complaint to the Office of the Information Privacy Commissioner Queensland.

Information on this website

This website uses Google Analytics (including Display Advertising Features) to gather anonymous information about visitors to help us monitor and improve the website. Google Analytics uses first-party cookies and JavaScript code to gather information about how visitors use the site. For example, number of visitors, browser information, pages viewed, IP address and demographic information. The information will be transmitted to and stored by Google on servers in the United States. 

This data is used by Brisbane City Council to analyse how visitors use the website in order to improve your user experience.

You can choose not to allow Google to collect your information by opting out of Google Analytics or specifically opt out of Google Analytics Display Advertiser Features

In addition, the website uses Facebook Pixels to tailor content specifically for you within Facebook and measure the success of campaigns. Facebook pixels use cookies, JavaScript code, web beacons and similar technologies to gather information. No personally identifiable information is shared with us by Facebook. The information will be transmitted to and stored by Facebook on servers in the United States. You can choose to opt out from tailored content through your Facebook settings.

The website uses Qualtrics intercepts to allow you to provide feedback on the website’s content and design. Qualtrics may use first-party cookies and JavaScript code to gather information about website usage including but not limited to: device and browser information, number of pages visited and time spent on the website. Qualtrics complies with applicable data privacy laws in its role as a data controller of its own data and as a data processor of customer data.

In accordance with our Privacy Policy, Council does not collect or keep any personally identifiable information, nor track visits to any non-Council websites.

Before entering the application process, check whether the information required is accessible via administrative or other means (e.g. through Council’s publication scheme). If the information is accessible, an application under the RTI Act 2009 or IP Act 2009 should not be lodged.

To check if information is already accessible, you can: 

An RTI or IP application may be made under the RTI Act 2009 or IP Act 2009 for access to information. This includes CCTV footage held by Council.

Applications under the RTI Act 2009 and IP Act 2009 are made by completing the Right to Information and Privacy Access Application form (either online or by paper application), providing certain types of information and paying the application fee. 

You can request footage from our CCTV. Footage from our cameras is available for up to 20 days from the date of recording.

Before requesting CCTV footage, phone Council on 07 3403 8888 to check a CCTV camera is in the location and that the footage is still available.

If you are a government agency, such as the Queensland Police Service or the Department of Transport and Main Roads, you can request CCTV footage online.

Individuals and non-government organisations can request CCTV footage by lodging a RTI application.

If you email or post the completed application form, you will also need to complete the credit card authorisation. Alternatively, we will contact you to arrange payment of the relevant fee.

Where evidence of identity is required to be lodged with an access application, this needs to be a certified copy (witnessed by a lawyer or notary public, a commissioner for declarations or a justice of the peace) of one of the following: 

  • current driver’s licence
  • identifying page of current passport/birth certificate
  • copy of a prisoner’s identity card certified by a corrective services officer
  • statutory declaration of an individual who has known the applicant for at least one year.

Applications will be processed within 25 working days, unless an extension is required.

Council's Publication Scheme

The Publication Scheme includes the public release of Civic Cabinet decisions and Council website or document information.

The Establishment and Coordination Committee (Civic Cabinet) has adopted a publication scheme for the proactive public release of its decisions.

The pages or documents available from the lists below may be accessed and downloaded free of charge. Copies may also be obtained from a Council Customer Centre. There may be a small charge for this service.

By registering to this service, you accept that Council will use the contact details provided such as your email address and telephone number to notify you of system related information for example outages, updates or upgrades. Your contact details will be kept private and treated in accordance with Council’s Privacy Statement
  2. Your obligations and warranties 
    1. You must use our online forms in a responsible manner. You must not do any act that we reasonably consider to be inappropriate, is unlawful or is prohibited by any laws applicable to our website and our online forms, including but not limited to: 
      1. any act that would constitute a breach of either the privacy (including uploading private or personal information without an individual's consent) or any other of the legal rights of individuals; 
      2. uploading files that contain viruses that may cause damage to our property or the property of other individuals; 
      3. posting or transmitting to our forms any unauthorised material including, but not limited to, material that is, in our opinion, detrimental to or in violation of our systems or a third party's systems or network security. 
    2. The online forms are for your personal use or internal business operations only. You must not modify, copy, distribute, display, perform, reproduce, publish, license, commercially exploit, transfer or sell any Content, software, products or services contained within our online forms.

    4. You warrant that any information that you upload to, or input onto, our online forms is true and accurate to the best of your knowledge and that you have used your best endeavours to ensure the truth and accuracy of that information.

  3. Our warranties and disclaimers 
    1. The information on our online forms is not comprehensive and may not be up-to- date, secure or error-free. To the maximum extent permitted by law you release us from, and in no event shall we be liable for, any direct or indirect loss, damage, claim or expense - irrespective of the manner in which it occurs - whether due to our own negligence or otherwise - which may be suffered due to your use of our forms.

    3. The indemnity in clause 6.b is a continuing obligation and survives termination, completion or expiration of these Terms and Conditions.
