The Public Land and Council Assets Local Law 2014 (the Local Law) ensures Council assets remain accessible and safe for locals and visitors. This includes parks, malls, roads and footpaths. 

The Local Law allows Council to:

  • protect valued assets in Brisbane
  • regulate and manage activities in or on these assets
  • require consent to carry out certain activities.

Parks

Council cares for parks in our city so residents and visitors can continue to enjoy them safely.

You may need approval to run an event or other commercial activity in a park.

Permissions for mall activities

You need permission to busk in, fundraise near or gain vehicle access to the Queen Street or Valley malls.

We regulate these activities to protect all mall users.

Roadside business

We regulate commercial activities on Council roads under the Local Law.

This helps protect motorists, pedestrians and road workers. You will need approval to conduct on-road vending.

Driveway permit

You must have a permit to build, repair or modify a residential or commercial driveway. 

This keeps our neighbourhoods safe and ensures driveways meet the relevant standards.

Road and footpath permits

We regulate activities on roads and footpaths to ensure public health and safety.

You need to apply for a permit to use or close a road or footpath.

 

Roadside business approval

You need consent to use Council roads, footpaths, verges or colonnaded areas for commercial or promotional purposes. They include:

  • promotional initiatives or campaigns 
  • displaying or storing boats or vehicles 
  • installing or operating a vending machine
  • running a stall, booth or stand
  • using tables, chairs or a vehicle for a commercial or promotional activity.

To get consent for these activities, you must apply for standing stall or vehicle consent.

This consent is in addition to any approvals, permits or licences needed for the activity. For example, a food vendor wanting to base themselves in a roadside position will require consent, as well as a food business licence.

Note

Selling a motor vehicle on or from a road is a prohibited activity under the Local Law. You may be issued an on-the-spot fine for this offence.

Apply for standing stall or vehicle consent

1 Before you apply
  • Ensure the location for your standing stall or vehicle doesn’t cause traffic hazards, interrupt free traffic movement or impact pedestrian safety. 
  • Prepare your supporting documents. You need to provide:
    • a photograph of the proposed area
    • a photograph or plan of the standing vehicle/stall/booth/stand/tables or chairs to be used 
    • information on how pedestrian safety will be managed 
    • information on how customer queuing will be managed 
    • plans to scale showing dimensions and distances to neighbouring properties and street furniture (maximum A3) 
    • permission from the Department of Transport and Main Roads (if the site is on a state-controlled road).

2 How to apply

Complete the online form to apply for standing stall or vehicle consent.

  1. Select the ‘Commercial activity on a Council road’ application type. Your proposal doesn’t need to relate to a food business.
  2. Supply your information and supporting documents.
  3. Pay the application fee using Visa or Mastercard. 
3 After you apply

We’ll notify you of the outcome within 20 working days.

If your application is successful, you need to pay the relevant occupation fee.

Note

Any consent will be issued to a single individual at a single specified location only.

Reasons for refusal

Your application will be refused if:

  • the site is located on a road in a way that would prevent safe access to a neighbouring property
  • the site is near a school, shop, other approved standing vehicle or outlet selling similar goods
  • the use will create hazardous and/or nuisance situations
  • the vehicle is positioned in a place or at a time when it’s against the law
  • the site is outside the Central Traffic Area and the vehicle can’t be located:
    • within the road reserve
    • at least 10 metres clear of the nearest traffic running lane
    • at least 50 metres clear of the nearest intersection.

Consent renewals and variations

Consent renewal 

A renewal notice is sent to annual consent holders before the expiry date. To renew for another year, respond to the renewal notice and pay the fee of $111.40. 

Variation of conditions 

If you wish to change a condition of your current consent, apply to Council and pay a fee of $393.85.

Council will assess the request and determine whether to amend it.

Inspection request 

You can request an inspection report if you:

  • are planning to buy an existing business with a current approval for a standing vehicle, stall, both, stand or tables and chairs 
  • need to demonstrate compliance for an insurance or bank application. 

This report will confirm the current compliance status of the premises or activity.
