This website is owned and operated by Brisbane City Council (ABN: 72 002 765 795). By using this website, you agree to these Terms and Conditions, which include Council’s Privacy Policy. You should review Brisbane City Council's privacy, copyright and disclaimer statements are designed to protect your rights and govern the use of information on this website. You should consider these Terms carefully and immediately stop using our website if you do not agree to these Terms.
In these Terms, 'us', 'we' and 'our' means Brisbane City Council.
- Registration
- You may need to be a registered user to use some of our online forms.
- When you register and activate your account, you will provide us with personal information such as your name, email address and telephone number. You must ensure that this information is accurate and current. We will deal with all personal information we collect in accordance with our Privacy Statement. Please be aware your personal information will be used to complete your request and to help us improve our service delivery to you.
- When you register you create your own profile. You are responsible for keeping your profile information, including password, secure and are responsible for all use and activity carried out under your user ID.
- By registering to this service, you accept that Council will use the contact details provided such as your email address and telephone number to notify you of system related information for example outages, updates or upgrades. Your contact details will be kept private and treated in accordance with Council’s Privacy Statement.
- Your obligations and warranties
- You must use our online forms in a responsible manner. You must not do any act that we reasonably consider to be inappropriate, is unlawful or is prohibited by any laws applicable to our website and our online forms, including but not limited to:
- any act that would constitute a breach of either the privacy (including uploading private or personal information without an individual's consent) or any other of the legal rights of individuals;
- uploading files that contain viruses that may cause damage to our property or the property of other individuals;
- posting or transmitting to our forms any unauthorised material including, but not limited to, material that is, in our opinion, detrimental to or in violation of our systems or a third party's systems or network security.
- The online forms are for your personal use or internal business operations only. You must not modify, copy, distribute, display, perform, reproduce, publish, license, commercially exploit, transfer or sell any Content, software, products or services contained within our online forms.
- You warrant and declare that to the extent that you use our online forms on behalf of another person (for example, to performs a conveyancing search), that the other person has consented to you using our online forms on their behalf.

- Intellectual property rights
- Unless otherwise indicated, we own or license from third parties all rights, title and interest (including copyright, designs, patents, trademarks and other intellectual property rights) in our online forms and in all of the material (including all text, graphics, logos, audio and software) made available on our online forms.

Council reserves all other intellectual property rights.
- Right to suspend or terminate service
- We reserve the right to restrict, suspend or terminate, without notice, your access to our online forms, any content, or any feature of our online forms at any time without notice and we will not be responsible for any loss, cost, damage or liability that may arise as a result.
- Liability
- To the maximum extent permitted by law you release us from, and in no event shall we be liable for, any direct or indirect loss, damage, claim or expense - irrespective of the manner in which it occurs - whether due to our own negligence or otherwise - which may be suffered due to your use of our forms.
- You indemnify us and our employees, councillors, agents and contractors (Those Indemnified) against any direct or indirect loss, damage, claim or expense made against, or suffered or incurred by, Those Indemnified, which arises from or is any way connected with:
- your use of our form;
- your use of the information or materials contained on the particular form; and/or
- your breach of these Terms and Conditions.
- The indemnity in clause 6.2 is a continuing obligation and survives termination, completion or expiration of these Terms and Conditions. It will not be necessary for us to incur any expense or to make any payment before enforcing a right of indemnity conferred by clause 6.2 and you must pay on demand any amount that you must pay under an indemnity in clause 6.2.
- General
- Your use of this forms and these Terms and Conditions are governed by the law of Queensland and you submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in Queensland.
- If any of these Terms and Conditions are invalid or unenforceable, they will be struck out. All other Terms and Conditions will remain in force.
- You can send us feedback about our online forms. We may at our discretion, use, reproduce, publish, modify, adapt and transmit your feedback to others free of charge and without restriction and by using this form, you consent for this to occur.
- All records will be retained and disposed of according to approved Retention and Disposal schedules under the Public Records Act 2002(Qld).
