Information for existing advertising device approval holders

An application can be made for an extension of time to complete building work, or to transfer, cancel, restore or make a minor amendment to an existing advertising device approval.

Extension of time to complete building work

Within 1 year after the date of an advertising device approval the building work must be completed. An approval holder may apply to Council to approve 1 extension for a period of up to 6 months.

An extension application can only be considered if it is at least 15 business days before the date the building work would ordinarily need to be completed by. You need to provide a reason for the extension request as well as photos of the building work completed to date.

Transferring an approval

An approval holder may apply to Council to transfer an approval to a new party. A person who is the owner, manager or controller of land or premises on which an advertising device has been installed, erected or displayed may also apply to Council to transfer an approval to a new party where it can be demonstrated:

  • the advertising device has been installed, erected or displayed without the consent of the person; or
  • the person’s consent for the installation, erection or display of the advertising device has been withdrawn or revoked; or
  • the person granted an approval is no longer permitted to occupy or use the land or premises on which the advertising device has been installed, erected or displayed.

The application must include sufficient details about the transferee. If the approval holder or the transferee are not the owner of the land, an owner’s consent form must be completed.

Amend an approval

An approval holder may apply to Council to make a minor amendment to an existing approval, including conditions or the built form. A change cannot be made which results in any electronic display component of the advertising device exceeding 4 square metres.

The application must include sufficient details about the proposed amendment. If the approval holder or the transferee are not the owner of the land, an owner’s consent form must be completed.

Cancel an approval

An approval holder may apply to Council to cancel an approval. A person who is the owner of land or premises on which an advertising device has been installed, erected or displayed may also apply to Council to cancel an approval where it can be demonstrated:

  • the advertising device has been installed, erected or displayed without the consent of the person; or
  • the person’s consent for the installation, erection or display of the advertising device has been withdrawn or revoked; or
  • the person granted an approval is no longer permitted to occupy or use the land or premises on which the advertising device has been installed, erected or displayed.

The advertising device must have been removed or have ceased use/operation.

If the approval holder or the transferee are not the owner of the land, an owner’s consent form must be completed.

An approval holder may apply to Council to restore a lapsed approval. An application must within 60 business days of the end of the term of the approval, unless there are extenuating circumstances.

An owner can be a range of entities, for example individual, corporation, trust, body corporate and more. Each entity type has different requirements, so ensure the consent is signed in the way that is valid for the entity.
