All properties in Brisbane are subject to the requirements of Council’s planning scheme, Brisbane City Plan 2014 (City Plan).

City Plan outlines how and where businesses in Brisbane can operate. This includes home-based businesses and businesses run from outside the home.

Before you use a property for business purposes, you must ensure you that you understand the relevant planning rules to avoid potential legal issues or penalties.

 To do this, you may need to:

  • find key facts about your property 
  • understand the planning scheme codes
  • know the preferred locations 
  • be aware of legislation requirements.

Confirm details about your property

Use City Plan online to find planning requirements that apply to your property. They determine what type of land use and development is permitted on your property.  

You’ll need to confirm your property zoning and if:

  • located in a neighbourhood plan
  • covered by an overlay.

The type of business you’re operating, as defined by City Plan, and where it's located determines the codes that will apply.

The planning scheme codes outline requirements that ensure the day-to-day running of your business doesn’t negatively impact the community or the environment.

Under City Plan, it’s preferable for different types of businesses to be located in certain zones.

Brisbane City Plan 2014 (City Plan) defines a home-based business as the use of a dwelling for a business that's subordinate to the residential use. It can operate from a house or a multiple dwelling (e.g. unit or townhouse) property.

  • home-based childcare.
