What is a Temporary Local Planning Instrument?

A Temporary Local Planning Instrument (TLPI) is a statutory planning instrument under the Planning Act 2016 (the Act) and may suspend or otherwise affect the operation of the Brisbane City Plan 2014 (City Plan).

They are used to respond to emerging planning issues. A TLPI is effective for up to 2 years but can be repealed earlier by Council.

A TLPI is an interim response used to protect Brisbane quickly and efficiently from adverse impacts in urgent or emergent situations.

A TLPI does not:

  • amend or repeal the planning instrument
  • create a superseded planning scheme
  • qualify as an adverse planning change under the Act.

Active TLPIs

On 6 June 2023, Council supported the progression of the TLPI 01/2023 Kurilpa Sustainable Growth Precinct and submitted the proposed TLPI to the Minister for State Development, Infrastructure, Local Government and Planning. TLPI 01/2023 was released for public consultation from 13 to 26 July 2023.

On 9 October 2023, the Minister released TLPI No. 2 of 2023 Kurilpa Sustainable Growth Precinct (TLPI 02/2023), which will have effect for a period of up to two years. The purpose of the TLPI is to facilitate housing supply, affordability and diversity and will ensure any new applications lodged for taller residential buildings in the Kurilpa Sustainable Growth Precinct area meet design excellence, flood resilience and community benefit outcomes.

The TLPI can be viewed on the Queensland Government website.

The Minister for State Development, Infrastructure, Local Government and Planning has made Temporary Local Planning Instrument No. 2 of 2021 (Colmslie Road Industry Precinct) for the Brisbane City Council local government area.

The TLPI came into effect from the gazettal date of 29 June 2021. The TLPI can be viewed on the Queensland Government website.

On 6 June 2023, Council supported the progression of the TLPI 01/2023 Kurilpa Sustainable Growth Precinct and submitted the proposed TLPI to the Minister for State Development, Infrastructure, Local Government and Planning. TLPI 01/2023 was released for public consultation from 13 to 26 July 2023.

TLPI 01/22 came into effect on 2 August 2022. It protected properties in the Moorooka War Workers’ Housing Estate by regulating development on specific sites listed in the TLPI.

It applied assessment provisions in addition to the current City Plan provisions.

Queensland Government TLPI 02/2021 (Colmslie Road Industry Precinct) came into effect on 29 June 2021.

This TLPI was made by the Minister for State Development, Infrastructure, Local Government and Planning.

TLPI 03/19 came into effect on On 11 June 2019. It protected the streetscape character and amenity of the locality of the premises by regulating development on specific sites listed in the TLPI.

It applied assessment provisions in addition to the current provisions of City Plan.

TLPI 02/19 came into effect on 5 March 2019. It protected the premises at 431 St Vincents Road, Nudgee, by regulating development on specific sites listed in the TLPI.

It applied assessment provisions in addition to the current provisions of City Plan.

TLPI 01/18 came into effect on 28 August 2018. It protected the premises at 21 Railway Terrace, Milton and 19 Mackay Street, Coorparoo by regulating development on specific sites listed in the TLPI.

It applied assessment provisions in addition to the current provisions of City Plan.

TLPI 05/19 came into effect on 21 November 2019. It protected significant civic spaces and iconic vistas in the City Centre by regulating development on specific sites listed in the TLPI.

It applied assessment provisions in addition to the then current provisions of City Plan. TLPI 05/19 replaced and had the same effect as TLPI 03/17.

TLPI 04/19 came into effect on 29 August 2019. It facilitated the protection of buildings constructed prior to 1911 on specific sites listed in the TLPI.

It provided for the assessment of development involving any pre-1911 building on the subject sites in addition to the then current provisions of City Plan. TLPI 04/19 replaced and had the same effect as TLPI 02/17.

TLPI 03/17 came into effect on 21 November 2017. It protected significant civic spaces and iconic vistas in the City Centre by regulating development on specific sites listed in the TLPI.

It applied assessment provisions in addition to the then current provisions of City Plan.

Note

This TLPI was replaced by TLPI 04/19.

TLPI 01/17 came into effect on 7 March 2017. It protected the cultural heritage significance of the Brasch’s Service Station building and facilitated assessment of the suitability of development or re-use of land at 108 Breakfast Creek Road, Newstead, or on adjoining land.

The TLPI applied in addition to the then current provisions of City Plan. The TLPI 01/17 expired at the end of 7 March 2018.

TLPI 05/16 came into effect on 7 December 2016. It facilitated the protection of buildings constructed prior to 1911 on specific sites listed in the TLPI.

It provided for the assessment of development involving any pre-1911 building on the subject sites in addition to the then current provisions of City Plan. TLPI 05/16 expired at the end of 6 December 2017.

TLPI 04/16 came into effect on 5 August 2016. It provided assessment provisions for the development of the Seaview Hotel (as a Local Heritage place) and nominated adjoining land (as area adjoining heritage) and applied in addition to the then current provisions of City Plan.

TLPI 04/16 replaced TLPI 01/15. TLPI 04/2016 expired at the end of 4 August 2017.

TLPI 03/16 came into effect on 10 June 2016. It provided more certainty about the planning intent for the site, in order to guide redevelopment were the Australian Government (Department of Defence) to dispose of all or part of the Bulimba Barracks site at Apollo Road.

TLPI 03/16 applied in addition to the then current provisions of City Plan. TLPI 03/16 was repealed on the commencement of the amended Bulimba District Neighbourhood Plan on 19 May 2017.

TLPI 02/16 came into effect on 4 May 2016. It facilitated the protection of residential buildings constructed prior to 1911 on specific sites listed in the TLPI.

It provided for the assessment of development involving any pre-1911 building on the subject sites in addition to the then current provisions of City Plan. TLPI 02/16 expired at the end of 3 May 2017.

TLPI 01/16 came into effect on 8 February 2016. It facilitated the protection of residential buildings constructed prior to 1911.

It provided for the assessment of any pre-1911 building on the subject sites in addition to the then current provisions of City Plan. TLPI 01/16 expired at the end of 7 February 2017.

TLPI 01/15 came into effect on 7 August 2015. It provided assessment provisions for the development of the Seaview Hotel (as a Local Heritage place) and nominated adjoining land (as area adjoining heritage) and applied in addition to the then current provisions of City Plan.

TLPI 01/15 was repealed upon commencement of TLPI 04/16 on 5 August 2016.

TLPI 01/14 came into effect on 8 May 2014. It provided for the assessment of the removal or demolition of any residential building constructed prior to 1911 within the Demolition Control Precinct and Demolition Control Precinct (Local Character Significance), as well as those buildings identified by TLPI 01/14 as being residential buildings constructed prior to 1911.

TLPI 01/14 was repealed on the commencement of City Plan on 30 June 2014.

TLPI 01/13 came into effect on 8 May 2013. This TLPI was created in order to protect residential buildings constructed prior to 1911 and provided for the assessment of the removal or demolition of any residential building constructed prior to 1911 within a Demolition Control Precinct or Demolition Control Precinct (Local Character Significance), as well as those buildings identified by TLPI 01/13 as being residential buildings constructed prior to 1911.

TLPI 01/13 expired at the end of 7 May 2014.

Following the Brisbane floods in January 2011, Council took steps to provide guidance for development in flood-affected areas.

To do this, Council adopted Temporary Local Planning Instrument 01/11 - Brisbane Interim Flood Response and subsequently on 16 May 2012, adopted Temporary Local Planning Instrument 01/12 (TLPI 01/12) - Brisbane Interim Flood Response.

TLPI 01/12 expired on 15 May 2013 and was replaced by the Brisbane Interim Flood Response provisions in the Brisbane City Plan 2000.

Brisbane City Plan 2000 was superseded by Brisbane City Plan 2014 on 30 June 2014. The provisions of Brisbane City Plan 2014 now guide development in flood prone areas.
