Switch to rates email billing competition - Terms and conditions

  1. These terms and conditions set out all of the information regarding the Brisbane City Council – Switch to rates email billing competition (the Terms and Conditions). 
     
  2. The promoter of this competition is Brisbane City Council ABN 72 002 765, whose principal office is at Brisbane Square, 266 George Street, Brisbane (the Promoter).
     
  3. Information on how to enter this competition forms part of these Terms and Conditions.
     
  4. Competition entry is deemed acceptance of these Terms and Conditions.
     
  5. Prize: There are twenty (20) prizes available to be won for this competition, each consisting of one (1) $100 Everyday WISH eGift card or Everyday WISH Gift card (redeemable in store or online at Woolworths Supermarkets, BIG W, BWS, Dan Murphy's and participating EG Ampol fuel sites) (each a Prize).
     
  6. The Prize is not exchangeable or transferable and cannot be redeemed for cash. Any additional expenses incurred by the Prize winners, other than those outlined in these Terms and Conditions, are the responsibility of the Prize winners. 

    The Prize is also subject to the specific terms and conditions of Woolworths Group Limited ABN 88 000 014 675 as regards the use, redemption and acceptance of the Prize. The Prize winner will not be entitled to any monetary compensation in connection with the Prize in any circumstances. 
     
  7. Competition period: This competition will open at 12.00am AEST on 16 September 2024 and close at 11:59pm AEST on Sunday 1 December 2024. No entries submitted after this time will be eligible to win the Prize.
     
  8. How to enter: Entrants who meet the Eligibility criteria set out in these Terms and Conditions must enter by:
    1. making a new application for email rates notice billing during the competition period; 
    2. remaining registered /or subscribed for email rates notice billing at the time of the draw; and
    3. only one entry will be accepted per Council rates notice. 
       
  9. Eligibility: To be eligible to enter this competition, a person must:
    1. be the owner or an authorised person or organisation who can act on behalf of the owner of the land identified on a Council rates notice; or an entity who asked for services to be supplied for structures on non-rateable land;
    2. be in receipt of, or entitled to receive, a current Council rates notice; and
    3. must not be an employee or contracted staff of any of the Promoter, a government agency or a Council controlled entity.
       
  10. Competition draw: The winners of the competition will be the first twenty (20) eligible entries randomly drawn through a computerised draw by an employee of the Promoter at 9:00am AEST on 2 December 2024. The decision of the Promoter will be conclusive, and no correspondence will be entered into. 
     
  11. Winner notification: The winner will be notified via email or telephone by an employee of the Promoter on or before 5:00pm AEST on 4 December 2024.
     
  12. Prize claim: A winner must claim the Prize by 5:00pm AEST on 12 December 2024 (the Prize Claim Date) by responding to the email or telephone notification of the Promoter’s employee in the manner directed by the Promoter. 

    If a Prize is not claimed by the Prize Claim Date, the winner of that Prize (as originally drawn) will cease to be the winner and will not be entitled to claim the Prize. 

    The Promoter, in its absolute discretion, reserves the right to not award the Prize to any entrant, including without limitation, if the Prize is not claimed by the Prize Claim Date.
     
  13. No liability of Promoter: The Promoter accepts no responsibility whatsoever for late, misplaced, lost, or ineligible entries. The Promoter makes no representations or warranties as to the quality, suitability or merchantability of the Prize. Despite any other provision of these Terms and Conditions, to the maximum extent permitted by law, the Promoter is not liable for:
    1. any loss or damage whatsoever (including but not limited to direct loss, indirect loss, economic loss, special loss or consequential loss) which is suffered or incurred by an entrant (including without limitation any Prize winner); or 
    2. without limiting paragraph (a), any personal injury or death or loss of, or damage to, property in connection with entry into the competition or acceptance of the Prize,

      howsoever such liability arises and whether arising in tort (including without limitation in negligence), for breach of contract (including without limitation under any indemnity), under statute, in equity or otherwise. This condition is not intended to exclude any liability which cannot be excluded under Australian consumer protection laws, and where the Promoter has such liability, that liability is limited, in the discretion of the Promoter, to the resupply of the Prize or compensation equal to its value.
       
  14. Privacy consent: By entering this competition, the entrant acknowledges and consents to their personal information including email address, phone number and full name being collected and stored by the Promoter for the purpose of this competition in accordance with the Promoter’s privacy policy.
     
  15. Force Majeure: If for any reason this competition is not capable of running as planned (including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter), which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to take any action that may be available, and to cancel, terminate, modify or suspend the competition. 
     
  16. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same Terms and Conditions.
     
  17. Competition updates or cancellation: Council reserves the right to modify these Terms and Conditions, including key dates in conditions 7, 10, 11 and 12 at any time, and to cancel or amend the competition at any time without notice or further recourse to the entrants. 
     
  18. Disqualification: The Promoter reserves the right in its sole discretion to disqualify any or all entries from any person who tampers with, or benefits from tampering with, the entry process which as a result corrupts or affects the administration, security, fairness, integrity or proper conduct of the competition or who provides false or misleading information in their Entry or who is determined by the Promoter to be ineligible.
