Sir Thomas Brisbane Planetarium Galaxy Gift Shop terms and conditions
Returns, exchanges and refunds (excluding tickets)
- These terms and conditions set out all the information which apply to your purchase at the Sir Thomas Brisbane Planetarium Galaxy Gift Shop (Planetarium Gift Shop) (the Terms and Conditions).
- The Planetarium Gift Shop is managed by Brisbane City Council ABN 72 002 765 795 acting through its Community Facilities and Venues branch in the Lifestyle and Community Services division, whose principal office is at Brisbane Square 266 George Street, Brisbane (Council).
- For all information about the purchase of tickets to shows and events at the Planetarium (Tickets), please see the Terms and Conditions for Purchase of Tickets.
- The purchase of goods comes with consumer guarantees that cannot be excluded under Australian Consumer Law. Under Australian Consumer Law, you are entitled to a replacement or refund for a major failure of a good.
- Change of mind: You are entitled to a refund or exchange as long as the item is returned in ‘original condition’ with original proof of purchase documentation.
‘Original condition’ means that the item hasn’t been opened or used, is still in its original packaging and all manuals, documents, packaging and accessories are included.
- A Change of mind entitlement does not apply to the purchase of:
(a) Tickets;
(b) gift vouchers; or
(c) pierced jewellery.
- Proof of purchase: All returns, refunds and exchanges must be accompanied by one of the following proof of purchase documents:
(a) register receipt of the purchased good; or
(b) a financial statement (such as a bank statement, credit card statement) showing the purchase made at the Planetarium Gift Shop.
- Refund processing: When your refund has been approved, it will be processed and a credit will automatically be provided using your original payment method.
- Governing jurisdiction: All purchases of gifts at the Planetarium Gift Shop shall be governed exclusively by the laws of Queensland and any disputes arising under these Terms and Conditions are subject to the non-exclusive jurisdiction of the courts of Queensland.
- No liability of Council: To the extent permitted by law, Council and its staff accept no liability for any injury, damage or loss (including consequential loss) that you or any other person may suffer whatsoever arising out of or in any way connected with the purchase of goods from the Planetarium Gift Shop except to the extent that the injury, damage or loss was caused by a wilful or negligent act or omission of Council or its agents. Where liability cannot be excluded or modified by law, including pursuant to Australian Consumer Law, the liability of Council and its staff is limited to the minimum permitted at law.
- Amendment to Terms and Conditions: Council may modify these Terms and Conditions from time to time. Any purchases you make at the Planetarium Gift Shop following any such amendment constitutes your agreement to follow and be bound by the Terms and Conditions as amended.
