Waste Smart Games 2023 terms and conditions

  1. These terms and conditions set out all of the information regarding the Brisbane City Council Waste Smart Games 2023 competition (the Terms and Conditions).
     
  2. The promoter of this competition is Brisbane City Council ABN 72 002 765 795, whose principal office is located at Brisbane Square, 266 George Street, Brisbane (the Promoter).
     
  3. Submitting an entry to this competition is deemed acceptance of these Terms and Conditions.
     
  4. Competition period: The time for submission of entry in accordance with condition 8 and condition 9 opens at 8am AEST on Monday 13 February 2023 and closes at 4pm AEST on Friday 13 October 2023 (Competition Period). No entries submitted after this time will be eligible to win the competition.
     
  5. Prize details: There are three (3) prizes available to be won for the competition as follows:

    (each a "Prize")
     
  6. Prize values are accurate as at the commencement date of the competition and any variation after that date is beyond the Promoter’s control; Any additional expenses, costs, fees, or charges associated with the Prize or incurred by the Prize winners, other than those outlined in these Terms and Conditions, are the responsibility of the Prize winners. The prizes are not exchangeable or transferable and cannot be redeemed for cash.
     
  7. The Prizes are subject to any restrictions specified in condition 5 above and the specific terms and conditions of the Prize provider. The Prize winner will not be entitled to any monetary compensation in connection with the Prize.
     
  8. Eligibility
    (a) To be eligible to enter this competition, an entrant must:
    (i) be a Queensland Independent, Catholic or state primary, secondary or P-12 school located within the Brisbane Local Government Area (an Entrant); and
    (ii) have obtained written approval from the school's principal to enter this compeition; and
    (iii) have the parent or guardian of each child who is under the age of eighteen (18) that may appear in photographs or videos submitted by the School to the Promoter in connection with this competition complete the online parental consent form.

    (b) Outside school hours care, childcare centres, kindergartens and students enrolled in distance education or home schooling are not eligible to enter the competition.
     
  9. How to enter: To enter this competition, an Entrant must:
    (a) complete and submit an Expression of Interest Registration form (to be completed by a school contact who will be the main contact point between the entrant school and the Promoter throughout the course of the competition (Lead Contact)); and
    (b) complete and submit proof of the completion of all of the following activities in accordance with condition 11:
    (i) Activity 1 - Waste Audit;
    (ii) Activity 2 - Community Involvement;
    (iii) Activity 3 - Video or Mascot; and
    (iv) Activity 4 - Sustainability improvements.
     
  10. Methods for Submission: An Entrant must submit all of the entry requirements in condition 9 to the Promoter by one or more of the following means:
    email to: wastesmartgames@brisbane.qld.gov.au
    For a file larger than 30 megabytes Sharefile or Google Docs can be used.
    Insert sent via registered post to Att: Waste Smart Community, Regional Operations Centre, 20 Tradecoast Drive Eagle Farm.
    Discuss courier or collection options with the Waste Smart Community team.
     
  11. Number of entries:
    (a) A maximum of one entry per Entrant is permitted where an Entrant consists exclusively of:
    (i) year levels within prep to year 6(Primary Year Levels);or
    (ii) year levels exclusively within year 7 to year 12(Secondary Year Level).

    (b) A maximum of two entries per Entrant is permitted where an Entrant includes both Primary Year Levels and Secondary Year Levels provided that only one entry consists solely of Primary Year Levels and one entry consists solely of Secondary Year Levels.
     
  12. The Promoter will not accept entries which are incomplete, illegible or which are generated by computers or other automated means.
     
  13. The Promoter reserves the right to disqualify any entry in the event of non-compliance with these Terms and Conditions or if, in the Promoter’s reasonable opinion, the entrant tampers or interferes with an entry mechanism in any way.
     
  14. Activity Details: An Entrant must complete all of the following activities:
    (a) Activity 1- Waste Audit: An Entrant must submit details of a visual school waste audit conducted at their school in 2023 which must include, at a minimum, two photographs of the waste audit that took place and a general overview of the data provided by the audit. Entrants may book a free loan of Council’s Waste Audit Kit to assist with completing this activity or conduct a school waste audit with their own equipment by:
    (i) following prompts and inserting data into the online School Waste Assessment Tool; and/or
    (i) Reading waste audit tips in the Guide to Reducing Waste in Schools.

    (b) Activity 2- Community Involvement: AnEntrant must take part in one of the following four events:
    (i) students at the school must attend an excursion at the Towards Zero Waste Centre (Excursion) between 1 January 2023 to the closing date of the Competition Period (a person must be at least 8 years old to enter the Centre); or
    (ii) the Entrant must hold a waste incursion event at the school with Council’s Environment Centre education team. An incursion event involves either the ‘It’s not a load of rubbish’ session or ‘What’s in the bin?’ session. These can be booked from this link [https://www.brisbane.qld.gov.au/clean-and-green/natural-environment-and-water/environment-centres/environment-centres-school-learning-program]. Alternatively, a customised incursion, can be held upon application to the Waste Smart Community team or
    (iii) if the Entrant is a school participating in the Bush Neighbours Program at the time the Competition Period opens, that entrant automatically satisfies this condition 14(b). For the avoidance of doubt, an entrant will need to have hosted activity number four, which is offered as part of the Bush Neighbours Program; or
    (iv) if the Entrant has a Year 10 cohort participating in the Lord Mayor’s Youth Environmental Leadership Network in 2023, that Entrant automatically satisfies this condition 14(b).

    (c) Activity 3 –Mascot OR Video: An Entrant must create and submit either a recycling-related video OR a mascot in accordance with this condition 14(c):
    (i) Recycling Video:  Create an original video, up to 3 minutes in length that tracks the journey of how the Entrant recycles at the school. Video specifications: The video must be digitally submitted in the form of a web link, mp4 or mp3 file, sharefile link or Google Docs link. and should be uploaded using the naming convention <<[Schoolname] – Video – [NameofVideo], unless the file submitted is a web link.
    OR
    (ii) Mascot: Construct a school mascot made wholly from recycled materials and write a brief description of the mascot and recycled materials used. A photograph of the mascot and the mascot description must be submitted in accordance with condition 10. The photograph must be submitted as a JPEG or PDF file.
     
    (d) Activity 4 – Sustainability Improvements: An Entrant must submit details of how its school has taken steps to improve recycling or minimise waste in 2023. Suggestions and guidance is available in ‘A school’s guide to reducing waste’ booklet, downloadable from Council’s website. Entrants should focus on the:
    - potential for volumes diverted from landfill,
    - ease of implementation and
    - longevity of the initiative.
     
  15. The Promoter may, at its sole discretion request an Entrant to provide additional evidence of completion of an activity having regard to the requirements set out in condition 14. The Entrant must provide such information to the Promoter promptly after any request and the Entrant must satisfy the Promoter that it meets all of the requirements set out in condition 14. If the Entrant fails to provide such evidence upon request, or if at any time, the Promoter is not satisfied with the entry requirements submitted by the Entrant, then, without limiting any other rights of the Promoter, the Promoter may deem an entry ineligible.
     
  16. Judging and Prize awarding:
    (a) Winner of Best Creative Piece and Winner of Best School Recycling Improvement: All eligible entries will be reviewed by a panel of judges appointed by the Promoter (the Judging Panel) for the purpose of deciding the winners of the Prize for Best Creative Piece and the Prize for Best School Recycling Improvement. The Judging Panel will determine the winners of these two Prizes based on the following criteria:
    (i) Prize for Best Creative Piece - The winner for the ‘best creative’ will be selected based on judging criteria that includes: research, information, presentation and creativity (particularly, regarding Activity 3); and
    (ii) Prize for Best School Recycling Improvement - The winner of the ‘best school recycling improvement’ will be based on criteria that includes: impact, longevity of the improvement (long term improvement is better than short term), replicability of idea in other schools, and ease of use for school community.

    (b) Waste Smart Games Winner: After the winners of the Prizes for Best Creative Piece and the Best School Recycling Improvement are decided, the Waste Smart Games Winner will be the first eligible entry randomly drawn by an officer of the Promoter (Waste Smart Games Officer) from the remaining eligible entries. For the avoidance of doubt, the winners of the Prizes for Best Creative Piece and the Best School Recycling Improvement will be ineligible to win the Waste Smart Games Winner Prize and the maximum number of prizes that an eligible entrant can win is limited to one Prize.

    All decisions made by the Promoter (including the Judging Panel and the Waste Smart Games Officer) regarding any aspect of the competition are final and no correspondence will be entered into.
     
  17. Winner Notification: Prize winners will be determined no later than 9am AEST on Friday 10 November 2023. All Prize winners will be notified by an officer of the Promoter from the Waste Smart Community team via phone or registered email address by 4pm AEST on Friday 10 November 2023.
     
  18. Prize Claim: Prize winners must claim their Prize by responding to the email or phone call received with the requested details by 12 noon AEST Friday, 24 November 2023 (Prize Claim Date).
     
  19. If (having made reasonable efforts) the Promoter or one of its officers cannot contact a Prize winner, or if a Prize is not accepted or claimed by the Prize Claim Date, the Promoter will:
    (a) where the Prize is not claimed for the Best Creative Piece or the Best School Recycling Improvement, the Judging Panel will award that Prize to a “runner-up” as determined by the Judging Panel in its sole discretion, provided that the “runner-up” has not claimed another Prize under this competition; or
    (b) where the Prize for the Waste Smart Games Winner is not claimed, the Promoter will re-draw a new winner and provide a new date and time by which the new winner must claim the Prize.
     
  20. The re-draw process may apply on any number of occasions (at the sole discretion of the Promoter), until such time as the Prize is claimed by a winner within the required prize claim period. 
     
  21. The Promoter, in its absolute discretion, reserves the right to not award the Prize to any Entrant, including without limitation, if the Prize is not claimed by the Prize Claim Date or any subsequent period provided for a new winner to claim the Prize.
     
  22. Prize delivery: Prizes will be delivered to the Prize winner via registered post, courier or hand delivered to the Lead Contact of the winning Entrants.
     
  23. Acknowledgement: When communicating about the competition an Entrant may acknowledge the Promoter in school community communications in any newsletter articles and social media posts.
     
  24. No Liability of the Promoter:
    (a) The Promoter accepts no responsibility whatsoever for any problems or technical malfunction of any communication network or late, misplaced, lost or ineligible entries.
    (b) The Prize winners are responsible for their use of the Prize, including complying with all relevant laws and any applicable terms and conditions of use of the Prize. The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any Prize.
    (c) Despite any other provision of these Terms and Conditions, and to the maximum extent permitted by law, the Promoter is not liable for:
    (i) any loss or damage whatsoever which is suffered or incurred by an Entrant (including but not limited to direct, indirect, economic loss or consequential loss (which includes loss of actual or anticipated profit, loss of goodwill, loss of reputation, loss of opportunity, loss of savings and/or loss of contract); or
    (ii) without limiting condition 24(c), for any personal injury or death or loss of, or damage to property sustained in connection with the entry into the competition, or acceptance or use of, any prize,
    howsoever such liability arises and whether arising in tort (including without limitation in negligence), for breach of contract (including without limitation under any indemnity), under statute, in equity or otherwise. The Promoter accepts no responsibility for any tax liabilities that may arise from winning the Prize. This paragraph is not intended to exclude any liability which cannot be excluded under Australian consumer protection laws. Any such liability is limited to the resupply of the relevant prize.
     
  25. Privacy consent:
    (a) By entering this competition, the Entrant acknowledges and warrants that is has obtained all necessary consents for:
    (i) personal information to be collected, used and stored by the Promoter for the purpose of conducting this competition and for the purposes set out in the Promoter’s Privacy Policy (available at https://yoursay.brisbane.qld.gov.au/privacy);
    (ii) images and videos containing personal information to be published in Council’s publications, website and social media platforms; and
    (iii) images or video containing personal information to be reproduced and/or exhibited by the Promoter and its subsidiary companies for any purpose.

    (b) Any personal information provided to the Promoter as part of competition will be protected in accordance with the Promoter’s obligations under the Information Privacy Act 2009 (Qld) and in accordance with the Promoter’s Privacy Policy.
     
  26. Licence and Copyright
    (a) By entering the competition, the Entrant as the owner of any image or video submitted as part of the competition (the “Materials”), grants to the Promoter the right to:
    (i) maintain a copy of Materials for archival purposes in the Promoter’s internal systems;
    (ii) publish the Materials on the Promoter’s publications, website and its social media platforms; and
    (iii) allow the Materials to be reproduced and/or exhibited by the Promoter and its subsidiary companies for any purpose.

    (b) When exercising its rights in condition 25(a), the Promoter will acknowledge and give attribution to the owner of the Materials in all reproductions of the Materials as the creator and owner of the Materials.

    (c) Whilst the Promoter will take care to ensure the quality and integrity of the reproduced Materials, the Entrant acknowledges that adapting the original Materials for presentation may result in enlargements and slight variations.
     
  27. Warranties of the entrant: In entering this competition, the Entrant warrants that:
    (a) the entrant owns or has obtained all necessary consents of the ownership and intellectual property rights both present and future, including rights under the Copyright Act 1968 (Cth), in respect of or in connection with copyright (including future copyright) and moral rights (including performance protection) and any other third party right or interest (Intellectual Property Rights) in all entriesand Materials submitted to the Promoter for this competition, including without limitation to allow the Promoter to use the entries and Materials as contemplated in these terms and conditions;
    (b) if the entrant is not the owner of the Intellectual Property Rights in the Materials submitted, the entrant must arrange for the owner of the Intellectual Property Rights in the Materials to grant the Promoter a licence to use the Materials in accordance with this condition 27;
    (c) entry into this competition will not infringe the Intellectual Property Rights of any person or give rise to any breach of performing right or unauthorised use or any third party right;
    (d) acts done by the Promoter in the exercise of its rights under this condition 27 will not infringe any Intellectual Property Rights of the Entrant or any third party; and
    (e) they will not act in a manner inconsistent with the rights of the Promoter at any time; and they have freely entered this competition after having the opportunity to carefully consider these Terms and Conditions.
     
  28. Force Majeure:
    (a) If for any reason this competition is not capable of running (including due to infection by computer virus, mobile network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cases beyond the control of the Promoter), which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to take any action that may be available, and to cancel, terminate, modify or suspend the competition.
    (b) In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, epidemic, strikes; the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same Terms and Conditions.
     
  29. Competition updates or cancellation: the Promoter reserves the right to modify these Terms and Conditions at any time and to cancel or amend the competition at any time with notice to the Entrants and the Entrants acknowledge and agree that they will have no rights of recourse or any other claims against the Promoter in the event the Promoter cancels or amends the competition. Any updates to these Terms and Conditions will be published on the Promoter’s website at https://www.brisbane.qld.gov.au/clean-and-green/rubbish-tips-and-bins/reducing-waste-at-work-in-schools-and-in-the-community/reducing-waste-in-schools/waste-smart-games/waste-smart-games-2022-terms-and-conditions.
  30. These Terms and Conditions are governed by the laws of Queensland.
