Amendments to City Plan effective 1 January 2007 (update 12)
Note: these amendments may also include consequential changes in other sections of City Plan.
City Plan Maps
- Amendments to the road hierarchy at Tilley Road, Wakerley to bring the city wide road hierarchy in line with the Wakerley Local Plan
Chapter 2
- Provisions in the Strategic Plan to improve the recognition of pre-1946 masonry housing styles such as the Californian bungalow and 'timber and tin'
Chapter 3
- Amendments to the Area intent and Desired Environment Outcomes for the Environmental Protection Area, to ensure this land is protected from inappropriate development
- Amendments to allow for protection of pre-1946 masonry housing styles as well as timber and tin architecture in Low Density Residential Areas
- In Low-medium Density Residential Areas, amendments to emphasise that only 'timber and tin' architecture will be protected
- Inclusion in the intent for the Low Density Residential Area, that 450 square metres is the minimum lot size for sites in the Demolition Control Precinct. Changes to the level of assessment table to make lots less than 450 square metres in the Low Density Residential Area in the Demolition Control Precinct generally inappropriate

- Fortitude Valley Local Plan - amendments to clarify levels of assessment for Low-medium Residential land within the James Street Precinct
Chapter 5
- Centre Amenity and Performance Code:
- removal of arterial road vehicle access provisions from the Child Care section of the code. This is already addressed in the Transport Access and Servicing Code
- introduction of acceptable solutions to address air quality from heavily trafficked roads on Child Care Facilities and a new map showing heavily trafficked roads
- Child Care Facility Code:
- greater flexibility in the location of child care facilities is facilitated by providing the option of not co-locating with a centre or other community facilities if the child care facility is located near high frequency public transport
- removal of arterial road vehicle access provisions that are already addressed in the Transport Access and Servicing Code
- introduction of acceptable solutions to address air quality from heavily trafficked roads on Child Care Facilities and a new map showing heavily trafficked roads
- Demolition Code:
- additional text in the Application and Purpose of this code clarifying what is meant by pre-1946
- inserting a new purpose statement, emphasising retention of other housing styles in the Low Density Residential and Character Residential Areas
- traditional building character has been expanded to recognise alternate pre-1946 housing styles and materials
- amendment to the acceptable solutions to clarify only timber and tin architecture is to be protected in the Low-medium Density Residential Area
- House Code:
- clarification that minor structures such as chimneys, flues and aerials are not considered when determining the overall height of a house
- correction to levels of assessment stated in the Residential Design–Small Lot Code reference
- deletion of superseded energy efficiency provisions superseded by provision and correction to minimum water supply required for fire fighting
- Residential Design-Character Code:
- amendment to the acceptable solutions to remove bias towards ‘lightweight’ materials
- additional exemptions to provide for the raising of existing houses
- Residential Design-Small Lot Code:
- additional exemptions for provision of small sheds, roofs over existing decks, gatehouses and double carports
- inclusion of a non-statutory note indicating extensions exempt from the code are still subject to the Standard Building Regulations and a non-statutory note indicating where to find the definition of average width
- inclusion of a definition for carport
- clarification of when built to boundary walls are allowed, where front and rear boundary setbacks are measured from, front boundary setbacks for rear allotments and that garage design provisions do not apply to rear lots
- inclusion of new double width garage provisions catering for double carports and lots of 15m or greater in width and clarification that double garages on steeply sloping blocks may override the front boundary setback requirements of the building envelope
- clarification that minor structures such as chimneys, flues and aerials are not considered when determining the overall height of a house

- Update of charges to align with the 2006/2007 Council Fees and Charges for the development contributions for water supply and sewerage headworks

- Replace references to the Standard Building Regulations with either Building Regulation or Building Act as appropriate

- clarify that the Landscaping Code applies to landscaping solutions within the development site rather than also on the street
- various wording changes to strengthen and clarify definitions, performance criteria and acceptable solutions to align with current industry and council practice
- various wording changes to reflect Council’s Crime Prevention through Environmental Design principles
- remove references to some surface treatments and security lighting as these are more appropriately addressed by the relevant design codes
- remove a requirement regarding location of plants around meters as their location is generally not known at the development application stage
- Heritage Place Code:
- introduce provisions for Heritage Precincts
- remove provisions allowing the development to be exempt from the Code and levels of assessment to be altered where Council has prepared a report indicating the place is not of heritage value
